Terms

This site is operated by Eric Dewhirst, operating as ActivateMerchant (“ActivateMerchant,” “we,” “us”). By using activatemerchant.com you agree to these terms. If you do not agree, please do not use the site.
ActivateMerchant publishes scores and benchmarks for e-commerce product pages. These scores are automated, opinion-based assessments generated by applying a consistent, published methodology to publicly accessible web pages. They reflect our assessment of conversion-related and machine-readability factors at the time a page was captured.
Our scores are not statements of factabout any brand, its products, its revenue, or its conduct, and they are not a measure of a company's quality, trustworthiness, or value. They are one methodology's point of view, offered for informational and comparative purposes. A page changes over time; a score reflects a single moment. Reasonable people can disagree with any individual assessment, and we welcome that (see “Requesting review, correction, or removal” below).
Brand names, logos, and trademarks shown on this site belong to their respective owners and are used for identification and commentary only. Their appearance does not imply any affiliation with, endorsement by, or partnership with those brands.
If your brand's page has been scored and you believe the assessment is inaccurate, out of date, or you would simply prefer it not appear publicly, email eric@activatemerchant.com and we will review it promptly. We will correct genuine errors, re-score on request where appropriate, and remove a brand's public listing at the brand's reasonable request. We would rather be fair than be right.
Anything provided through ActivateMerchant, including scores, teardowns, findings, and recommendations, is general information, not professional, legal, financial, or guaranteed business advice. We do not warrant any particular outcome, such as an increase in conversions, traffic, or revenue, from acting on our recommendations.
Paid teardowns, audits, and ongoing tracking are delivered under separately agreed scope and pricing. Nothing on this site is an offer that creates an obligation until both parties agree in writing.
Do not misuse the site: no attempts to breach security, scrape at a scale that disrupts service, resell our content without permission, or use the site unlawfully. We may suspend access for misuse.
The methodology, rubric, written teardowns, site design, and aggregate benchmark data are the property of ActivateMerchant. You may reference and link to public pages; you may not republish substantial portions of our content as your own without permission.
The site links to third-party websites we do not control. We are not responsible for their content or practices.
To the fullest extent permitted by law, ActivateMerchant is not liable for any indirect, incidental, or consequential damages arising from use of the site or reliance on its content. The site and its content are provided “as is,” without warranties of any kind.
We may update these terms from time to time. The date above shows the latest version.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules.
